Generally criminal law involves cases where a government entity, such as the State of Maryland, is a party against an individual or firm, where the government seeks a conviction and penalties, such as incarceration and/or a fine. This is distinguished from civil law cases which generally involve an individual or firm against another individual or firm, where money damages and/or injunctive relief is sought.

Generally, felonies are crimes subject to imprisonment by one year or more and misdemeanors are crimes punishable by incarceration of less than one year.
Traffic offenses, such as DUI, driving while license is suspended, fleeing and eluding, and even speeding technically fall within the ambit of criminal law because the government, such as the State of Maryland, is a party, an individual is the defendant, and a conviction can result in a penalty.
Defenses may be available to criminal charges. Examples of defenses are alibi, defense of others, defense of property, duress, entrapment, insanity, mistake of fact, resisting unlawful arrest, self defense, and in some cases voluntary intoxication.
The Constitution of the United States provides rights to persons charged with crimes in order to potect the public. Examples are the right of protection from unlawful searches and seizures and from arrests without probable cause.
